An Official Committee of Unsecured Creditors typically represents creditors standing at the end of the line, often with divergent interests. This constituency enjoys the assistance of experienced professionals paid for by the Estate and, typically, the support of the Court and the US Trustee. Hence, the Committee is a powerful tool for unsecured creditors and can often present a thorn in the side of the Debtor and a roadblock in the plan confirmation process.

This panel will explore the economic incentives that often drive Committees, how Committees have shaped outcomes in major corporate chapter 11 cases, and the ways in which institutional players–bondholders, hedge funds, banks and private equity–can harness their power.
