Case Narrative

DSI serves as the post-confirmation Plan Administrator for Coudert Brothers, a New York City-based law firm founded in 1853, which once boasted 600 attorneys in offices worldwide.  DSI assisted in the formulation of the Chapter 11 Plan, which included negotiating an agreement with partners who, in exchange for a contribution to a fund for the benefit of creditors, would be released by the estate and protected with an injunction against those who might pursue claims against the firm and its partners. DSI analyzed the firm’s accounts to determine the Jewel v. Boxer (“unfinished business”) liability claims which could be asserted against other law firms who became the recipients of entire practice areas or individual partners.  DSI was able to craft significant initial monetary settlements with respect to the unfinished business claims against certain law firms, such that the estate is now anticipating a significant dividend to its creditors. DSI continued to collect all outstanding accounts receivable from former clients, both domestic and international, to review and bring preference actions and to close out the firm’s 401(k) and pension plans, cooperating with the Pension Benefit Guaranty Corporation.
