Case Narrative

AgriBioTech, Inc. (ABT) was a publicly-traded company that was the sixth largest seed company in the world specializing in developing, breeding, processing, packaging and distributing varieties of forage (hay crops) and cool-season turf grass seeds.  ABT distributed seeds throughout the United States and worldwide from locations in 29 states and two foreign countries.

Immediately after ABT filed bankruptcy, DSI was retained as the Debtor’s Crisis Manager and Reorganization Consultant.  Given that most senior management had resigned prior to the filing, DSI professionals assumed most key functions of the Debtor that were left open following extremely high turnover at the company. These roles included the management, accounting, treasury and operations of the company.  DSI oversaw all aspects of the company’s operations leading up to and after its sale.  DSI professionals negotiated 15 separate sale transactions with gross proceeds in excess of $100 million. This case was unique from the aspects that there were creditor constituencies with varying interests.  DSI was able to help negotiate a settlement between these parties and help reach a level of consensus.
